The case stems from a fatal crash in Texas in which a fatigued truck driver fell asleep at the wheel, killing five people and seriously injuring another. The decision in Montgomery v. Caribe Transport II confirms that federal law does not shield freight brokers from state-level negligent hiring claims.
Amy Witherite, founder of Witherite Law Group and attorney representing the affected families, emphasized the significance of the ruling for victims seeking accountability.
“This decision recognizes that brokers play a critical role in selecting carriers and share responsibility for avoiding companies with poor safety records,” Witherite said.
